Terms and Conditions
These Terms govern your use of the Make10 mobile game ("the App"). By creating an account or signing in, you confirm that you have read, understood, and agreed to these Terms and to the Privacy Policy. If you do not agree, do not use the online features of the App.
These Terms are written for global use; if any provision is unenforceable in your jurisdiction, the remaining provisions stay in effect.
1. Who can use the App
- You must be at least 13 years old to use online communication features (global chat, clan chat, clan mail, private messages). Gameplay has no minimum age.
- You confirm that the date of birth you provide at sign-up is accurate.
- If you are between 13 and the age of majority in your jurisdiction, you confirm that you have your parent or guardian's permission to use the App.
2. Your account
- You are responsible for your account credentials and for all activity under your account.
- You may not share your account, sell it, transfer it, or use anyone else's account.
- Choose a username that is not impersonating another person, brand, or trademark, and is not offensive. We may rename or revoke usernames that violate this rule.
- You may delete your account at any time from Settings → Account → Delete account.
3. Acceptable use — what you must not do
This is a friendly puzzle game. To keep it that way, you must not:
- Harass, threaten, intimidate, or bully other players.
- Post or send content that is abusive, hateful, violent, discriminatory, sexually explicit, or otherwise unlawful.
- Behave in a way that endangers, scares, distresses, or targets minors (anyone under 18, even if they are old enough to use the App).
- Impersonate other people, brands, or organisations.
- Spam, advertise unrelated products, or solicit personal information from other users.
- Cheat — including but not limited to using modified clients, bots, automation, exploits, or tampering with stored game state to inflate scores, trophies, or rewards.
- Attempt to disrupt, reverse-engineer, attack, or interfere with the App's servers, the matchmaking system, the leaderboards, or any other player's experience.
- Resell, rent, sublicense, or commercially exploit the App or its content.
- Use the App to violate any law that applies to you.
4. Reports, moderation, and account actions
- You can report messages and players from inside the App.
- We review reports and may take action including: deleting messages, temporarily muting accounts, temporarily suspending accounts, or permanently terminating accounts.
- We reserve the right to terminate, suspend, or restrict any account at any time, for any reason or no reason, with or without notice, at our sole discretion. This includes accounts where we reasonably suspect violation of these Terms, accounts that have been the subject of repeated credible reports, accounts created to evade prior bans, and accounts whose behaviour we believe is harmful to the community.
- We are not obliged to provide a refund of any in-app purchases on terminated accounts, except where required by applicable law.
5. In-app purchases and subscriptions
- In-app purchases and subscriptions are processed by Apple under their own terms.
- Consumable purchases (e.g. shuffles, flair points) are consumed when used and cannot be restored.
- Non-renewing items (e.g. username change) are spent on use and cannot be restored.
- Auto-renewing subscriptions (Super Solver, Ultra Solver) renew at the end of each billing period unless cancelled in your Apple ID subscription settings at least 24 hours before the renewal date.
- Refunds are handled by Apple. We can help with technical issues but do not directly issue refunds.
- Prices and product availability may change at any time.
6. Virtual items and currency
- Flair points, premium points, shuffles, trophies, badges, cosmetics, and any other in-game items ("Virtual Items") have no real-world value, cannot be redeemed for real currency, and cannot be transferred outside your account.
- You receive a personal, non-exclusive, non-transferable, revocable licence to use Virtual Items inside the App. You do not own them.
- We may add, modify, or remove Virtual Items at any time, including rebalancing prices and pay-outs. Where reasonably possible, we will give notice.
7. User-generated content
- "User Content" means anything you post, send, or upload — chat messages, clan names and descriptions, usernames, avatars, and similar.
- You retain ownership of your User Content, and you grant us a worldwide, royalty-free licence to host, display, and transmit it as needed to operate the App and to enforce these Terms.
- You are responsible for your User Content and confirm that you have the right to post it.
8. Service availability and changes
- We aim to keep the App online but make no guarantees. The App is provided "as is" without warranties of any kind.
- We may add, remove, or change features at any time, including shutting down online features entirely (with reasonable notice where practical).
- Scheduled maintenance, server outages, third-party service issues (Apple, Supabase, Firebase, AdMob, Resend, Cloudflare) and other factors may make the App temporarily unavailable. We are not liable for these interruptions.
9. Limitation of liability
To the maximum extent permitted by law, strykowski-lab and the App's operators are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the App is limited to the greater of (a) the amount you paid us through in-app purchases in the 12 months before the claim and (b) USD 50.
Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify and hold harmless strykowski-lab from any claim, loss, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your User Content, or (c) your violation of any third-party right.
11. Privacy and data
Our processing of your personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.
12. Updates to these Terms
We may update these Terms from time to time. Material changes will be notified in-app at next sign-in; continuing to use the App after such notice constitutes acceptance. Non-material edits (typo fixes, clarifications) take effect immediately and are noted in the version history of this document.
13. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts of New South Wales, Australia, except that nothing prevents you from bringing a claim in your local courts where mandatory consumer-protection law requires.
14. Apple-required terms (App Store EULA addendum)
If you obtained the App through the Apple App Store, you acknowledge:
- These Terms are between you and strykowski-lab, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance and support.
- If the App fails to conform to any warranty, you may notify Apple, which will refund the purchase price; beyond that, Apple has no warranty obligation regarding the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
